Terms of Use

1. ABOUT THESE TERMS

These Terms of Use ("Terms") form a binding agreement between you ("you") and WarthogLab, an independent developer registered and resident in France ("WarthogLab," "we," "us," or "our"), governing your access to and use of the iOS application "Ultra Fast EV Charging Station" and any related services we provide (collectively, the "App").

By installing, accessing or using the App, you confirm that you have read these Terms and our Privacy Policy and that you accept them. If you do not agree, do not install or use the App.

2. ELIGIBILITY

You must be at least 13 years old to use the App. If the age of digital consent in your country is higher (for example, 16 in some EU Member States), you must meet that higher age. If you are a minor under the age of majority in your jurisdiction, you may use the App only with the involvement and consent of your parent or legal guardian. By using the App, you represent and warrant that you meet these requirements and that your use of the App does not violate any law applicable to you.

3. WHAT THE APP DOES — AND WHAT IT DOES NOT DO

The App is a passive informational and trip-planning tool. It provides:

• An interactive map of Tesla Supercharger locations compiled from publicly available information.
• Filters by status (open, under construction, planned), Supercharger version (V1–V4) and compatibility (Tesla-only versus stations open to other electric vehicles).
• A list of the nearest stations relative to your current location.
• A favorites list stored on your device.
• A journey planner that, on your device, computes a route between two points and identifies Supercharger stations near that route.
• The option to launch a third-party navigation app installed on your device (Apple Maps, Google Maps, Waze) or the Tesla app, with a destination pre-filled.
• Optional informational content about Tesla's public referral program.

The App does not:

• Charge any vehicle, start, stop, pay for or otherwise control a charging session.
• Communicate with Tesla's servers, your Tesla account, or your vehicle.
• Provide real-time information about whether a stall is occupied, in service, or compatible with your vehicle.
• Guarantee the accuracy, completeness, currency, or availability of any station, route, address, or technical specification.

Station and network data may be inaccurate or out of date. Always confirm route, station status and compatibility through official Tesla sources or the in-vehicle navigation system before relying on them.

4. NO ACCOUNT REQUIRED

The App does not offer or require user accounts, sign-up or login. Your favorites, filter preferences and onboarding state are stored locally on your device. Deleting the App removes that data. Because there is no account to recover, we cannot restore your local data.

5. LICENSE

Subject to your compliance with these Terms and, where applicable, with Apple's standard EULA, WarthogLab grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App on iOS devices that you own or control, for your own non-commercial use. All rights not expressly granted are reserved by WarthogLab and its licensors.

You agree that you will not, and will not allow any third party to:

• Copy, modify, translate, adapt or create derivative works of the App.
• Reverse engineer, decompile, or attempt to derive the source code of the App, except to the extent expressly permitted by mandatory law (in particular Article 6 of EU Directive 2009/24/EC).
• Rent, lease, sell, sublicense, distribute or transfer the App.
• Use the App to develop a competing product, or scrape, harvest or extract station data from the App in bulk.
• Remove or alter any proprietary notices.
• Use the App in any way that violates applicable laws or third-party rights, or that interferes with the App's operation, security, or other users.

6. SUBSCRIPTIONS, FREE TRIAL AND PAYMENTS

Some features of the App are made available through an auto-renewing subscription processed by the Apple App Store. The current price, billing cycle, and any free trial are displayed in the App and in the App Store before purchase.

• Free trial. If a free trial is offered and you accept it, the trial begins when you confirm the offer. Unless you cancel at least 24 hours before the end of the trial, the subscription will automatically convert to a paid subscription at the price displayed.
• Auto-renewal. Your subscription automatically renews for successive periods of the same length unless you turn off auto-renewal at least 24 hours before the end of the current period. Renewal is charged to your Apple ID payment method.
• Cancellation. You can cancel at any time in Settings > [your name] > Subscriptions on your iOS device. Cancellation takes effect at the end of the current paid period; you will retain access until then.
• Refunds. Apple processes refunds for App Store purchases. You may submit a refund request via reportaproblem.apple.com. Refund decisions are made by Apple at its discretion in accordance with the App Store terms.
• Price changes. If we change the subscription price, Apple will notify you and ask for your consent before charging the new price, in line with App Store rules.
• EU consumer right of withdrawal. Under Article 16(m) of EU Directive 2011/83/EU, your right of withdrawal does not apply once the supply of digital content has begun with your prior express consent and your acknowledgment that you thereby lose your right of withdrawal. By starting your subscription or trial, you give such consent and acknowledgment. This does not affect any more-favorable refund right offered by Apple.

7. APPLE APP STORE TERMS

The following clauses apply because the App is distributed via the Apple App Store. They supplement (and, where conflicting, prevail over) other parts of these Terms:

• These Terms are concluded between you and WarthogLab only, and not with Apple Inc. ("Apple"). WarthogLab, not Apple, is solely responsible for the App and its content.
• The license granted to you in Section 5 is limited to a non-transferable license to use the App on any Apple-branded products that you own or control as permitted by the Usage Rules set forth in the Apple Media Services Terms.
• Apple has no obligation whatsoever to provide any maintenance and support services with respect to the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.
• WarthogLab, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your use of it, including (i) product liability claims, (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement, and (iii) claims arising under consumer protection or similar legislation.
• If a third party claims that the App or your use of it infringes its intellectual property rights, WarthogLab, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such claim.
• You represent and warrant that (i) you are not located in a country that is subject to a US Government embargo or that has been designated by the US Government as a "terrorist supporting" country, and (ii) you are not listed on any US Government list of prohibited or restricted parties.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

8. THIRD-PARTY SERVICES, NAVIGATION APPS AND CONTENT

The App can launch other apps installed on your device, including Apple Maps, Google Maps, Waze, and the Tesla app, with a destination pre-filled. Your use of those apps is governed by their own terms of use and privacy policies. WarthogLab is not responsible for the content, accuracy, availability, or behavior of any third-party app or website.

9. TESLA REFERRAL DISCLOSURE

The App may display or link to Tesla's public referral program (for example, a ts.la/… URL). If a new Tesla customer uses such a link to make a qualifying purchase, the referrer (the App's author) may receive a benefit from Tesla under Tesla's own program rules. This is disclosed in line with the US FTC's Endorsement Guides and similar EU consumer-protection rules. Use of the referral link is entirely optional and does not change the price you pay Tesla. WarthogLab is not responsible for Tesla's referral program, the value of any benefit, eligibility, vehicle delivery, or any related issue, all of which are governed by Tesla.

10. PROHIBITED CONDUCT

You agree not to:

• Violate any law, regulation or third-party right.
• Interfere with or disrupt the App, the App Store, our processors, or any associated infrastructure.
• Bypass or attempt to bypass any access, security or rate-limiting measure.
• Use bots, scrapers, or other automated means to extract data from the App.
• Use the App in safety-critical situations or in any manner that distracts you from safe operation of a vehicle. Always observe local traffic laws and do not interact with the App while driving.
• Misrepresent your affiliation with WarthogLab, Tesla or any other party.

11. INTELLECTUAL PROPERTY

The App, its source code, design, text, graphics, layout, icons, and logos (other than third-party trademarks) are owned by WarthogLab or its licensors and are protected by copyright, trademark and other applicable laws. Third-party trademarks, including "Tesla" and "Supercharger", remain the property of their respective owners and are used solely for descriptive purposes (see the Tesla disclosure above). Nothing in these Terms transfers any intellectual property right to you.

12. DATA ACCURACY DISCLAIMER

Station information in the App is compiled from publicly available sources and may be incomplete, outdated or inaccurate. Station status, opening hours, number of stalls, available power and connector types can change without notice. Routes, distances and travel times computed by the journey planner are estimates produced by Apple MapKit on your device and may not reflect real-world conditions. Always verify critical information through Tesla's official channels and your vehicle's navigation system before relying on it.

13. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR ACCURACY OF DATA. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT INFORMATION IT DISPLAYS IS ACCURATE OR CURRENT.

Consumer rights notice (EU/UK and California): Nothing in this section limits or excludes any warranty, right, remedy or guarantee that cannot be limited or excluded under the law applicable to you. If you are a consumer in the European Union, the United Kingdom, or a US state that grants statutory implied warranties to consumers, you continue to benefit from those mandatory rights, including, where applicable, the legal guarantee of conformity (in France, the garantie légale de conformité under Articles L.224-25-12 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).

14. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WARTHOGLAB BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUES, LOST DATA, BUSINESS INTERRUPTION OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP, REGARDLESS OF THE LEGAL THEORY, WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US (THROUGH THE APPLE APP STORE) FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY (50) US DOLLARS.

Important consumer carve-out: Nothing in these Terms limits or excludes WarthogLab's liability for (i) gross negligence, willful misconduct, or fraud; (ii) death or personal injury caused by our negligence; (iii) any liability that cannot be limited or excluded under the law applicable to you (in particular, mandatory consumer-protection laws in the European Union, the United Kingdom, France, and US states with similar consumer rules). If you are a consumer based in such a jurisdiction, the caps and exclusions above apply only to the extent permitted by that law.

15. INDEMNIFICATION

To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless WarthogLab and its agents from any third-party claims, damages, liabilities, costs and expenses (including reasonable attorneys' fees) arising out of (i) your violation of these Terms, (ii) your violation of any applicable law, or (iii) your willful misconduct. This Section does not apply to consumers to the extent prohibited by mandatory consumer law.

16. TERMINATION

You may stop using the App at any time and uninstall it from your device. We may suspend or terminate your access to the App at any time, with or without notice, if we reasonably believe you have breached these Terms or applicable law, or if continued provision is no longer commercially or legally viable. Sections that by their nature should survive termination (including Sections 7 to 19) will survive.

17. CHANGES TO THESE TERMS

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes will be highlighted in the App or on this page before they take effect. If you do not agree with the updated Terms, stop using the App; continued use after the effective date constitutes acceptance of the updated Terms.

18. GOVERNING LAW AND DISPUTES

18.1 Governing law

These Terms are governed by the laws of France, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

18.2 Consumers in the EU/EEA, UK, and Switzerland

If you are a consumer habitually resident in the EU/EEA, the UK or Switzerland, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of your country of residence. You may bring proceedings in the courts of your country of residence, and we may bring proceedings in the courts of your country of residence as required by Article 18 of Regulation (EU) No 1215/2012 (Brussels I bis). The European Commission also provides an Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr (we are not, however, obligated or willing to participate in alternative dispute resolution proceedings before a consumer arbitration board).

18.3 Users in the United States

If you are a US-based user, you and WarthogLab agree first to attempt to resolve any dispute informally by contacting us at contact@warthoglab.com and allowing 60 days to negotiate in good faith. If a dispute is not resolved informally, you and WarthogLab agree that any dispute will be resolved on an individual basis in a court of competent jurisdiction. To the maximum extent permitted by applicable law, you and WarthogLab waive any right to participate in a class action or representative action against the other. You retain the right to bring an individual action in your local small-claims court for any qualifying claim, and the right to seek public injunctive relief in any forum where such relief is available and cannot be waived.

18.4 Other users

For users not covered by Sections 18.2 or 18.3, the courts within the jurisdiction of WarthogLab's registered residence in France will have exclusive jurisdiction.

19. MISCELLANEOUS

• Entire agreement. These Terms, together with the Privacy Policy and any in-App purchase terms, constitute the entire agreement between you and WarthogLab regarding the App.
• Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision will be replaced by a valid one that most closely reflects the original intent.
• No waiver. Our failure to enforce any right under these Terms is not a waiver of that right.
• Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of the relevant assets.
• Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control.
• Notices. Notices to us must be sent to contact@warthoglab.com. We may notify you in the App or by any reasonable means.
• Language. These Terms are made available in English. If we provide translations, the English version controls in case of conflict, except where mandatory law requires otherwise (in particular, in France, the French version will prevail for French consumers if and when one is published).
